Terms of Use
By downloading, accessing or using Nanuka (the "app"), you agree to these Terms of Use. Please read them. Your use of the app is also governed by our Privacy Policy, and by Apple's standard Licensed Application End User License Agreement, which applies as a baseline wherever these terms are silent.
1. Licence
We grant you a personal, limited, non-transferable, non-exclusive licence to use Nanuka on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. All intellectual property rights in the app, including its software, graphics, text and interfaces, remain with Nanuka.
2. Not a medical device, and not a substitute for supervision
Nanuka is a monitoring aid. It is not a medical device, and it is not a substitute for responsible adult supervision. It does not diagnose, prevent, monitor for or treat any condition, and it makes no claim to detect distress, illness or danger.
Never rely on Nanuka as the sole means of watching a baby or child. Like any product that depends on devices, batteries, Wi-Fi, cellular networks and an operating system, it can fail, be delayed, or be interrupted without warning. Alerts may not arrive. Keep following the safe-sleep and supervision guidance you would follow without it.
3. Subscriptions (Nanuka Pro)
Nanuka is free to pair and to use for audio monitoring. Live video and cry alerts are included with Nanuka Pro, an optional auto-renewable subscription, after an introductory period of full video and alerts that begins with your first monitoring session.
- Payment is charged to your Apple ID at confirmation of purchase.
- The subscription renews automatically at the then-current price for the same period unless it is cancelled at least 24 hours before the end of the current period.
- Your Apple ID is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your App Store account settings. Cancelling stops future renewals; you keep access until the end of the period you have paid for.
- Prices are set per storefront, vary by region, and are always shown to you in the app before you buy.
- Purchases are processed by Apple. Refunds are handled by Apple under the App Store Terms of Service, and are requested from Apple rather than from us.
We may change prices for future periods. Where we do, the change is applied through the App Store, and Apple will ask for your agreement before charging an increased price where its rules require that.
4. Acceptable use
You agree to use Nanuka only for lawful purposes, and only to monitor spaces and people you have the right to monitor. You must not use it to intrude on anyone's privacy, to observe or record people without a lawful basis, or in any way that breaks the law where you are. You are responsible for telling other adults in your home that a monitoring device is running where local law requires it.
You must not reverse engineer, resell, or attempt to interfere with the app or the services it connects to.
5. Availability and disclaimer of warranties
Nanuka is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation. We do not warrant that monitoring will be continuous, that a connection will always be established, or that any particular sound will be detected or any alert delivered.
6. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from missed or delayed alerts, interruptions, or reliance on the app. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded under the law that applies to you.
7. Governing law
These Terms are governed by the laws of the Republic of India, without regard to conflict-of-laws principles. Disputes are subject to the courts located in Jorhat, Assam, India, unless a mandatory consumer law where you live provides otherwise.
8. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected in the effective date at the top of this page and, where appropriate, communicated in the app. Continuing to use Nanuka after a change takes effect means you accept it.
